Mukurwe-ini MP John Kaguchia was arrested by officers from the Directorate of Criminal Investigations (DCI) after spending the night at Royal Media Services (RMS) in Nairobi.

According to reports, the MP remained inside the media station after appearing on Inooro TV's popular Kiririmbi programme. Kaguchia claimed that security officers had surrounded the media house and were waiting to arrest him immediately after the interview.

Instead of leaving the premises, the legislator stayed inside the building overnight, saying he feared being arrested outside the station.

On Monday morning, DCI officers apprehended him, saying they were investigating remarks he had allegedly made during a political rally in Kieni, Nyeri County.

The arrest immediately attracted national attention, with politicians, lawyers, civil society groups, and members of the public expressing different opinions about the move.

Some argued that investigators were simply carrying out their constitutional mandate, while others questioned whether the arrest was necessary and whether the matter could have been handled through summons instead.

Why Was John Kaguchia Being Investigated?

According to the MP, investigators were looking into statements he made during a political rally held in Kieni, Nyeri County.

During the rally, Kaguchia allegedly warned Mt. Kenya residents against supporting President William Ruto in the 2027 General Election.

Reports indicate that while addressing supporters in Kikuyu, the legislator allegedly stated that those who vote for President Ruto would be identified and "tracked to their homes."

Authorities viewed the remarks as potentially inflammatory and capable of inciting political tension.

Speaking after his arrest, Kaguchia maintained that his statements had been misunderstood and taken out of context. He argued that the issue should be handled by the National Cohesion and Integration Commission (NCIC), which is responsible for investigating hate speech and inflammatory political statements.

The MP also said he had not received any official summons before being arrested and questioned why police opted for an immediate arrest.

Overnight Stay at Royal Media Services

One of the most unusual parts of the incident was Kaguchia's decision to spend the night inside Royal Media Services.

After completing his television interview, the MP claimed police officers had surrounded the compound and erected roadblocks outside the media station. He later posted on social media saying he believed the officers intended to arrest him as soon as he stepped outside.

Kaguchia insisted he would not be intimidated by what he described as political pressure.

Throughout the night, security officers reportedly remained outside the premises while supporters and journalists closely followed developments. The situation attracted significant attention on social media, with many Kenyans debating whether the police operation was justified.

The following morning, DCI officers arrested him and began processing him for further investigations. Initially, reports indicated he would be taken to regional DCI offices before later being transferred to DCI headquarters along Kiambu Road for further questioning.

High Court Orders His Immediate Release

The legal battle took another turn after the High Court of Kenya at Kiambu intervened.

Court documents show that Hon. John Philip Gichohi Kaguchia filed an urgent application against the Inspector General of Police, the Director of Public Prosecutions, and other respondents.

After considering the application, the High Court issued several important directions. Among them was an order directing that Kaguchia be released from police custody immediately upon depositing a police cash bail of KSh 100,000.

The court also directed the respondents to file their responses within the specified timelines while setting a later date for further hearing of the application.

The ruling reinforced the constitutional principle that every suspect is entitled to due process and that courts have the power to protect individual rights while investigations continue. The case is expected to continue in court as judges determine the legal issues raised in the application.

DCP Party Leader Criticises Continued Detention

Following the court ruling, the Democracy for the Citizens Party (DCP) leader issued a strong statement regarding Kaguchia's detention.

According to the statement, the High Court had already ordered the immediate release of the MP after payment of the KSh 100,000 police cash bail. The DCP leader alleged that the Officer Commanding Station (OCS) at Kamukunji Police Station was continuing to detain Kaguchia despite the court order having been served.

He claimed the OCS was acting under instructions from senior officers and warned that failure to obey the court's directives could amount to contempt of court.

The DCP leader further advised the officer to comply with the court order, arguing that personal responsibility could arise if a court found that its orders had been deliberately ignored.

In his statement, he also referred to another criminal case involving a different police officer, saying officers should carefully consider the legal consequences of carrying out unlawful instructions.

These remarks reflect the DCP leader's opinion and form part of the wider political debate surrounding the case. Any allegations regarding compliance with court orders would ultimately need to be determined through the appropriate legal process.

The Constitution guarantees freedom of expression, allowing leaders and citizens to express their political opinions freely. However, the same Constitution and Kenyan laws also prohibit speech that amounts to incitement, hate speech, violence, or actions that threaten public peace and national unity.

Political leaders are therefore expected to exercise caution when addressing supporters, especially during politically charged rallies. Where authorities believe statements may have crossed legal boundaries, investigations may follow, although suspects also enjoy constitutional protections, including the right to legal representation, fair treatment, and due process.

Ultimately, it is the courts—not public opinion—that determine whether any criminal offence has been committed.
