Breaking News: Former High Court Judge Joseph Mbalu Mutava Dies at 75

NAIROBI, Kenya — August 22, 2026 — Former High Court Judge Justice Joseph Mbalu Mutava has died at the age of 75, leaving behind a legal career that included service on the High Court and a highly publicised judicial accountability case that went all the way to Kenya's Supreme Court.

Mutava, who was the husband of Kibwezi East Member of Parliament Hon. Jessica Nduku Mbalu, died on Saturday, August 22, after falling suddenly ill. Family sources said he collapsed at his rural home in Kithasyu and was rushed to Makindu Sub-County Hospital, where he was pronounced dead. His body was later transferred to Lee Funeral Home in Nairobi as the family began preparations for his final rites.

According to reports, Mutava had attended a burial ceremony on Friday and had shown no signs of illness before he suddenly developed complications later that night. His death came as a shock to his family, friends and members of Kenya's legal fraternity.

His death has triggered messages of condolence from political leaders, including President William Ruto, former Deputy President Rigathi Gachagua and Wiper Patriotic Front leader Kalonzo Musyoka.

President Ruto mourned Mutava as he extended his sympathies to Jessica Mbalu and the wider Mbalu family. Kalonzo, in his message, described the former judge as a public servant who served the country with honour, integrity and quiet distinction.

Gachagua also mourned the former judge, expressing his condolences to Jessica Mbalu and her family. He described the loss of a loved one and spouse as a painful ordeal and extended his sympathies to the people of Kibwezi East.

Justice Joseph Mbalu Mutava was appointed a Judge of the High Court of Kenya on August 23, 2011, following a competitive recruitment process recommended by the Judicial Service Commission. He subsequently served at the Milimani Commercial Courts.

His time on the Bench became particularly significant because of a disciplinary case that later became an important constitutional dispute concerning judicial accountability in Kenya.

In 2013, the Judicial Service Commission petitioned for the establishment of a tribunal to investigate complaints concerning Mutava's conduct as a High Court judge. A tribunal was subsequently constituted under Article 168 of the Constitution to investigate the allegations against him.

One of the central issues concerned Mutava's handling of a case involving businessman Kamlesh Pattni and matters surrounding the long-running Goldenberg scandal. The proceedings examined allegations concerning the manner in which the case was allocated and handled.

Mutava challenged the tribunal process and its findings, eventually taking the matter to the Supreme Court.

The judgment remains part of Kenya's jurisprudence on the constitutional process for investigating and removing judges from office.

The case was significant beyond Mutava himself because it dealt with the constitutional balance between judicial independence and accountability. It also examined the standard of proof applicable in proceedings for the removal of a judge from office.

Despite the controversy that surrounded the latter part of his judicial career, Mutava remained a prominent figure within Kenya's legal history.

Away from the Bench, he was known to many Kenyans as the husband of Jessica Nduku Mbalu, the Kibwezi East MP.

The couple's family has faced other painful moments in recent years. In January 2024, their son Benedict Musyoka Mbalu died in a road accident in Nairobi, adding another major loss to the family.

Mutava's death now brings another difficult chapter for the Mbalu family, with Jessica Mbalu mourning her husband as political leaders and friends rally around the family.

For Kenya's legal fraternity, his passing marks the death of a former High Court judge whose career was intertwined with one of the country's significant post-2010 constitutional cases on judicial accountability.
